TERMS & CONDITIONS – 4FILL LUMIX LOAN

ABOUT THIS SERVICE

This service is promoted by PANASONIC UK (the "Manufacturer"). 4Fill Europe Limited, a subsidiary of Simplysnap Ltd ("4FILL" or "The Company") is responsible for managing the booking process, delivery, collection, and other logistical aspects of the hire on behalf of the Manufacturer. This service offers a free hire of promotional equipment

Please read these Terms and Conditions carefully as they govern your participation in the free hire of promotional equipment offered by 4FILL for Panasonic UK's "Try Before You Buy" Lumix Loan promotion.

 

DEFINITIONS

In these Terms and Conditions

Click and Collect” means the service which enables you to pick up and drop off your hired Equipment from selected approved locations around the country (see website for locations).

Company” or “we/us” means 4FILL Europe Ltd, (4FILL) a subsidiary of Simplysnap Ltd of Unit 5, Wellbrook Farm, Berkeley Road, Mayfield, East Sussex, TN20 6EH.

Courier” means a reputable Courier organisation responsible for carrying the Goods to or from the Hirer

Deposit” means the amount required to be secured by 4FILL from the Hirer, either by way of a payment or a pre-authorisation hold, as a condition of hiring the Equipment.

Equipment” means the Equipment described in the Order confirmation as well as the packaging and any other Equipment or accessories included within the packaging (and any replacement parts or Equipment supplied).

“Free Hire” means the free hire of the Promotional Product(s) for a period offered under this Promotion, subject to these Terms and Conditions.

Hirer means a resident of Great Britain (England, Wales, and Scotland) aged 18 or over who registers for and hires a Promotional Product through The Website during the Promotional Hire Period. This definition applies irrespective of whether a specific hire fee is currently applicable as outlined within the Hire Period.

Hire Period” means the period starting at the time of delivery of the Equipment to the Hirer or collection of the Equipment by the Hirer and ending at the time of the return delivery or collection of the Equipment. The Manufacturer reserves the right to apply charges or discounts, including a discount of 100% resulting in no charge, to the Hire Period or any part thereof, at their sole discretion.  

Manufacturer” means PANASONIC UK, Maxis 2, Western Road, Bracknell, Berks, RG12 1RT as a branch of Panasonic Marketing Europe GmbH, whose registered address is Hagenauer Str. 43, 65203 Wiesbaden, Germany (“Panasonic UK”) being the promoter of this equipment hire service and the owner (or a legal representative of the owner) of the Equipment.

Order” means the Hirer’s Order for the hire of Equipment, as set out in the Order confirmation given by the Company and accepted by the Hirer (as the case may be).

Promotional Hire Period means the period between 00:00 on 1st May 2025 and 23:59 on 31st August 2025, during which the Free Loan is available, subject to these Terms and Conditions.

Promotional Product(s) means the specific item(s) of equipment offered for free hire under this Promotion, as listed on The Website.

The Website means the Lumix Loan website https://www.lumixloan.com operated by 4FILL Europe Limited, through which Hirers can hire Promotional Products.

 

  1. GENERAL TERMS AND AGREEMENT

1.1 This promotion offers Free Hire of the Promotional Product(s) when hired through The Website provided by 4FILL for Panasonic UK during the Promotional Hire Period, subject to these Terms and Conditions. Any Free Hire requires that a fully refundable Deposit is secured by 4FILL, either by way of a payment or a pre-authorisation hold for the Deposit amount, which will vary depending on the value of the Promotional Product(s).

1.2 This Promotion is only available to Hirers (as defined in the Definitions section) and applies only to Promotional Product(s).

1.3 To participate in this Promotion, Hirers must register with 4FILL and book a Promotional Product via The Website for a hire commencing within the Promotional Hire Period. By registering and booking, the Hirer confirms that all details given in their application to hire the Company’s Equipment are true and complete.

1.4 The Company reserves the right to refuse the acceptance of any Order or exclude claims and/or Hirers if it is not satisfied with the information provided or believes the service is not being used within the spirit it is intended or if the promotion is being abused in any way. The company’s decisions regarding the promotion are final, and no correspondence will be entered into.

1.5 These terms and conditions form the entire agreement between the parties and supersedes and extinguishes all prior agreements, promises, assurances, warranties, representations, and understandings between them, whether written or oral, relating to its subject matter.

1.6 No additions or alterations to these terms and conditions shall be binding on the Company unless agreed in writing and signed by a duly authorised signatory. Any terms and conditions proposed by the Hirer shall only apply if agreed by The Company in accordance with this paragraph.

 

  1. HOW TO PARTICIPATE & HIRE PERIOD

2.1 To qualify for the Free Hire promotion, the Hirer must book a Promotional Product via The Website during the Promotional Period. The Hirer is required to have a user account with 4FILL to participate. Hirers will be eligible for Free Hire from 4FILL subject to the terms outlined herein.

2.2 The Free Hire applies only if the hire request is made via The Website during the Promotional Period and the hire commences on The Website within the Promotional Hire Period.

2.3 The initial portion of the Hire Period will be provided free of charge as the Free Hire. The exact duration of this Free Hire and the total Hire Period will be confirmed in your Order Confirmation. If the Hirer chooses to hire the Promotional Product for longer than the Free Hire period, any additional period may be charged at 4FILL’s normal rate in accordance with 4FILL’S Terms and Conditions.

2.4 Free Hire and/or subsequent paid hire of the Promotional Products is subject to availability. 4FILL will not be liable for the failure to make Promotional Products available for hire.

2.5 4FILL will not process any Free Hire requests received after the expiry of the Promotional Period or any request which, in its opinion, is incomplete.

2.6 Only one Free Hire per Promotional Product is permitted per person.

2.7 A maximum of 6 Promotional Products per person or household in a calendar year shall qualify for Free Hire under this promotion.

 

  1. TERMS OF HIRE

3.1 The Hire of Equipment is for temporary use by the Hirer only. The Equipment may not be passed on to third parties without the express prior written consent of 4FILL.

3.2 The Hirer must not make, or allow to be made, any alteration or modification to the hired Equipment without the express prior written consent of 4FILL. The Hirer requires 4FILL’s prior written consent for any abnormal or hazardous use, or for taking the Equipment outside Great Britain or transporting it by non-I.A.T.A. airline scheduled flights.

3.3 If there is any suspicion that the Equipment is being used for any unauthorised activity, or otherwise in breach of these terms, the Manufacturer, through 4FILL, has the right to terminate the hire, and the products must be returned immediately.

3.4 The Hirer must notify 4FILL immediately in the event of any decision, notice, application, petition, or order relating to the administration, liquidation, receivership, winding up, or equivalent, of the Hirer. In such cases, 4FILL, acting on behalf of the Manufacturer, will be entitled to terminate the Hire and make arrangements to enter the premises to collect the Equipment.

3.5 The 4FILL service is designed to give individuals the opportunity to evaluate Equipment to inform and enable a prospective purchasing decision. It is not to be used to supplement Equipment for paid for and or commercial work, or where there is no intention or consideration of a purchase in the near future. 4FILL reserves the right to refuse orders, exclude claims and or Hirers if it is not satisfied with the information provided, or believes the service is not being used within the spirit it is intended.

 

  1. RESERVATIONS

4.1 Making an enquiry, whether by telephone, email, or in person, does not constitute a booking. An Order is deemed to have been placed and becomes binding, subject to the cancellation policy (Section 11), upon your receipt of an Order confirmation email.

4.2 Where the Equipment, for reasons outside The Company’s control, ceases to be available for the duration of the Hire Period, 4FILL shall inform the Hirer as soon as is practically possible. In such an event, 4FILL will endeavour to provide suitable replacement Equipment.

 

  1. EQUIPMENT CONDITION AND USE

5.1 The Equipment and any associated accessories made available for hire remain the absolute property of 4FILL and/or the Manufacturer. The Hirer acquires no right, title, or interest in the Equipment, save that it is hired to the Hirer for a mutually agreed period.

5.2 All Equipment and accessories undergo inspection prior to dispatch and are detailed on the Equipment Checklist provided with the Shipment Dispatch. Upon receipt of the Equipment, it is the Hirer's responsibility to verify that it is in satisfactory working order and free from damage.

5.3 Upon receiving the Equipment, the Hirer is required to examine and check it before use. If the Equipment is found to be defective or deficient upon receipt, 4FILL will endeavour to provide a suitable replacement, or the defects or deficiencies will be rectified without incurring additional charges, provided 4FILL is notified in writing before 10:00 am on the first day of use or, in the case of collection from a Click and Collect location, before 12:00 am (Midday) on the day of collection. The Hirer will be held liable for any missing Equipment, defects, or deficiencies that are not documented on the Equipment checklist, unless notified within these timeframes.

5.4 The Hirer shall not remove any labels affixed to, or otherwise interfere with, the Equipment, nor shall they make any permanent modifications to it. The Hirer undertakes to operate the Equipment in a safe and correct manner, adhering to the guidelines provided in the operating manual.

5.5 The Hirer accepts full responsibility for ensuring the safekeeping of the Equipment while it is in their possession. The Equipment must be returned by the Hirer in the same condition in which it was received, and in good working order (subject to reasonable wear and tear), and must include all original packaging and components.

 

  1. DELIVERY AND COLLECTION

6.1 The agreed Hire Period is communicated to the Hirer in the Order Confirmation and commences at the time of delivery of the Equipment to the Hirer or collection by the Hirer, concluding upon return delivery or collection.

6.2 The Hirer is solely responsible for confirming that the delivery and collection addresses selected on the order are accurate by reviewing the Order Confirmation email. The Company accepts no liability for errors in delivery and collection which may occur as a result of this information not being verified by the Hirer.

6.3 4FILL will deliver Equipment either to the Hirer's billing address (as provided by the Hirer) or to a designated Click and Collect location if this option is chosen. For deliveries to the billing address, the Hirer is responsible for ensuring that someone, preferably the intended user, is available to sign for or receive the Equipment upon arrival. 4FILL reserves the right to refuse delivery to addresses deemed insecure (such as communal postal addresses or PO boxes), and in such cases, the Hirer will be informed.

6.4 The Hirer shall accept delivery of the Equipment on the day the Courier first attempts to deliver. Where the Courier has attempted delivery, but the Hirer has not been present to accept it, the Courier will not return on the same day, and there is no guarantee as to the time of any subsequent delivery attempt. The Hire Period shall remain as specified on the Order Confirmation, unless otherwise agreed in writing by both parties.

6.5 When delivering Equipment, Couriers may, in certain circumstances, rely on GPS tracking or photographs as evidence of successful delivery and may not request a physical signature. By proceeding with an order, you agree to these terms. The Courier's obligation is to deliver to the address on the Item(s), not necessarily the named person. The Company shall not be liable in respect of any consignment delivered to the delivery address where any person misrepresents their authority to receive it or where the Courier delivers according to purported Hirer instructions.

6.6 Where the Hirer utilises facilities offered by the Courier to divert any part of a delivery to an address or location other than the original billing address, responsibility for the Equipment shall pass to the Hirer immediately upon diversion.

6.7 Equipment must be made available for collection by the Courier at the address agreed with 4FILL on the scheduled day of pickup. The Hirer is responsible for returning the Equipment in the packaging in which it was delivered, securely sealed. The Hirer shall be liable for any loss of or damage to the Equipment during transit resulting from a failure to repackage it in accordance with these instructions.

6.8 If the Equipment is not available for pickup on the scheduled day by the Courier, a failed collection fee of £25 (+ VAT if applicable) will be charged for the necessitated extension of hire.

6.9 If Equipment is not returned immediately after the Hire Period ends and the Hirer has not contacted 4FILL to explain the delay or negotiate a written extension, 4FILL will initiate steps to recover the Equipment, notifying the Manufacturer accordingly.

6.10 For next-day delivery, orders must typically be placed before 2 pm. A Free Hire request made for a hire commencing on a Saturday or Sunday will typically result in delivery on Friday and collection on Monday, as deliveries and collections are generally not available on weekends and public holidays.

6.11 Delivery within the usual timescales mentioned above cannot be guaranteed to all remote locations, and next-day delivery may not be possible in some areas due to limited Courier availability. Items may take up to 72 hours to deliver in such cases, but where reasonably possible, dispatch will be attempted earlier.

 

  1. CLICK AND COLLECT (COLLECTION AND DROP BACK)

7.1 When choosing the Click and Collect option, the Equipment will be available for collection from the chosen retailer after 1pm on the date specified in the Order Confirmation and during the Company's normal business hours. The Hirer will be required to present a valid Photo ID (passport or driving license) before the Equipment will be released.

7.2 If the Hirer does not collect the Equipment from the Click and Collect location on the date specified, The Company shall continue to make the Equipment available for collection during normal business hours on each business day until the end of the Hire Period. No adjustment to the Hire Period or any Hire Charges shall be occasioned by such late collection or non-collection.

7.3 Goods must be returned to the Click and Collect point before 11am on the morning after the Hire Period has finished. If the Equipment is not returned before 11am and misses the Courier collection, the Hirer will be charged a failed collection fee of £25 (+ VAT if applicable) and will be charged for the extension of hire. In the event Equipment is not returned within 24 hours of the collection date and notwithstanding Courier delays, the Hirer will be charged a fee equal to a full day’s standard hire charge for each day the Equipment remains unreturned.

7.4 The Hirer shall remain fully responsible for the Equipment until it is signed for by a member of staff at the agreed Click and Collect location.

7.5 Risk in the Equipment transfers to the Hirer immediately upon collection from the designated Click and Collect location. The Hirer shall be liable for any theft, loss, damage, or destruction howsoever caused to the Equipment while it is in their possession, notwithstanding that property in the Equipment shall remain at all times with The Company.

 

  1. LOSS OR DAMAGE TO EQUIPMENT

8.1 The Hirer shall be responsible for the safe keeping of the Equipment throughout the Hire Period and shall be liable to 4FILL for all loss of or damage to the Equipment howsoever caused. Neither 4FILL nor the Manufacturer is liable for third-party damage resulting from product misuse. The Hirer's liability for loss or damage to the Equipment is not limited to the amount of the Deposit.

8.2 The Hirer will notify 4FILL of any loss or damage to any Equipment on hire immediately, and where theft has occurred, the police should be informed and a crime reference number provided to 4FILL without unnecessary delay. Failure to report theft to the police and provide evidence may result in the Hirer being invoiced for the full retail value.

8.3 The Hirer shall not carry out or attempt to carry out any repairs to damaged Equipment or Firmware updates without the prior written permission of 4FILL. The Hirer shall pay 4FILL all costs for repairs to damaged Equipment. The Hirer shall pay to 4FILL the full cost of replacing any lost Equipment, or any Equipment, which in the reasonable opinion of The Company is uneconomic to repair, with new Equipment of the same or similar specification to that Equipment which has been lost or damaged. An administration fee of £25 will be added to each distinct missing part or damaged item.

8.4 Where Equipment is returned with missing components, the Hirer shall ensure that said components are returned to 4FILL by either Royal Mail Special Delivery or an approved carrier service within 3 working day of being notified. If the components are not returned by this time and no agreement has been made in writing between 4FILL and the Hirer, all monies owed for replacing said components will become immediately due and taken automatically from the Deposit or will be debited from the Hirer’s card. This includes but is not limited to batteries, memory cards, cases and other ancillary items connected with the Equipment.

8.5 4FILL recommends that Hirers use memory cards tested and supplied by 4FILL where available. Hirers may use their own memory cards, but the Hirer shall be liable for any damage caused to 4FILL‘s Equipment that results from the use of memory cards not supplied by 4FILL. 4FILL assumes no responsibility for damage or liability of any kind resulting from the use of the Equipment. All digital sensors are inspected and, where necessary, cleaned before dispatch of Equipment. 4FILL assumes no responsibility for dust attracted to the sensor after dispatch.

 

  1. DEPOSIT

9.1 The Hirer will be required to provide a Deposit that can be secured by 4FILL, either by way of a payment or a pre-authorisation hold for the Deposit amount, before 4FILL will dispatch any Equipment. The amount of the Deposit will be quoted online at the time of booking. The Deposit funds will be secured either at the time of booking or 7 days before the date of dispatch, whichever is closest to the day of dispatch. In the event of the funds not being available to secure the Deposit and 4FILL not being able to contact the Hirer, the reservation will be cancelled. 4FILL will release the pre-authorisation hold or process the Deposit refund as soon as practicable once the Equipment has returned and The Company is satisfied all Equipment is complete and undamaged. Please allow up to 8 working days for the funds to become accessible (for pre-authorisations) or to clear into the Hirer’s bank account (for refunds), as this processing time depends on the Hirer's bank.

 

  1. PAYMENT

10.1 Payment of any chargeable hire periods beyond the initial Free Hire, or any other fees and costs payable by the Hirer in accordance with these Terms & Conditions, shall be made before any Equipment is dispatched or become due as specified in the relevant clause. 4FILL shall be entitled to receive full payment of such due charges from the Hirer.

10.2 The Hirer shall pay all sums due to 4FILL under this contract without any setoff, deduction, counterclaim and/or any other withholding of monies. 4FILL reserves the right to charge the Hirer’s credit or debit card to the full value of the Equipment in the event the Hirer is considered to be in breach of these Terms & Conditions.

10.3 4FILL reserves the right to amend prices at any time and without prior notice. Orders are fulfilled on the understanding that prices charged are those current at the time of despatch.

10.4 All prices are exclusive of Value Added Tax and any similar taxes. All such taxes are payable by the Hirer and will be supplied in accordance with UK legislation in force at the tax point date.

 

  1. CANCELLATION POLICY

11.1 4FILL reserves the right to levy a £25 administration charge for any order cancelled by the Hirer up until 2 working days before the date of dispatch of the order. After this period, the Hirer shall be liable to pay either a cancellation charge equal to half the agreed hire charge or a £25 administration charge, whichever sum is greater.

11.2 If the Hirer cancels the order within 1 working day of the dispatch date, the Hirer shall be liable to pay to The Company either a cancellation charge equal to the full hire charge or a £25 administration charge, whichever sum is greater.

11.3 Where the Hirer's agreement would be subject to the provisions of the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013, the Hirer shall have the right to cancel the order by written notice up to 14 days after confirmation of that order. By accepting delivery of the Equipment ordered, defects or deficiencies notwithstanding, the Hirer agrees to pay the hire and courier charges for said Equipment.

11.4 Any request by the Hirer for cancellation of any order or for the re-scheduling of any deliveries will only be considered if made at least 72 hours before dispatch. This shall be subject to acceptance by 4FILL, who reserve the right to levy a reasonable administration charge for cancelled orders.

 

  1. INSURANCE

12.1 The Company reserves the right to ask for full value insurance if it cannot complete account verification checks to its satisfaction, or for high-value orders. If 4FILL requires you to hold insurance, you must prove to us that insurance is in place, and 4FILL must be satisfied with said cover prior to commencement of the hire. Where 4FILL is not satisfied with said cover, 4FILL reserves the right to cancel the hire until such time as sufficient cover is in place and 4FILL is satisfied.

12.2 4FILL will investigate all losses of whatever value thoroughly. Where the loss is suspected to be by theft, the Hirer has an obligation to report the loss to the police and to obtain a crime reference number without unnecessary delay. Please note, you remain liable for up to the full value of the Equipment and we will take whatever action necessary to recover any costs.

 

  1. INDEMNITY

13.1 The Hirer shall at all times fully indemnify 4FILL, its employees, servants and agents against all actions, costs, claims, demands, proceedings, or liabilities arising from or in conjunction with Equipment, materials or any other services supplied to the Hirer by 4FILL.

 

  1. TERMINATION

14.1 You agree that we, in our sole discretion, may terminate your use of the services we provide on our sites (including the Equipment hire service) and remove and discard any Content within such services, for any reason including, without limitation, if we believe that you have breached or acted inconsistently with the letter or spirit of these Terms and Conditions. We may also, in our sole discretion and at any time, modify or discontinue providing such services (in whole or in part), with or without notice.

14.2 You agree that any termination of your access to such services under any provision of these Terms and Conditions may be affected without prior notice. Further, you agree that we shall not be liable to you or any third party for any termination of your access to such services.

 

  1. DISCLAIMERS

15.1 To the fullest extent permitted by law, the Manufacturer and 4FILL shall not be liable for any loss, damage or injury of any nature howsoever caused, sustained by any Hirer under this promotion, except where caused by the proven negligence of the Manufacturer or 4FILL employees or agents resulting in personal injury or death.

15.2 The Manufacturer reserves the right to void, amend, and/or change this service at any time without incurring any liability whatsoever.

15.3 Without limiting the Company's rights under Section 1.4, the Manufacturer and 4FILL reserve the right to audit any hire requests to ensure compliance with these terms and conditions and to request additional information, supporting documents, or carry out background checks if deemed necessary. The Manufacturer and 4FILL reserve the right to refuse orders or exclude claims and/or Hirers if they suspect that the promotion is being abused in any way. The Manufacturer decisions regarding the promotion are final, and no correspondence will be entered into.

15.4 If any part of these terms and conditions is found by a court of competent jurisdiction or other competent authority to be invalid, unlawful, or unenforceable, then such part shall be severed from the remainder of these conditions, which shall continue to be valid to the fullest extent permitted by law.

 

  1. DATA PROTECTION

16.1 Any personal data submitted to 4FILL will be processed by 4FILL, its agents, and associated group companies for the purposes of administering this service (including processing bookings, managing delivery and collection, and communicating with the Hirer), and where applicable and with consent, for marketing purposes. The legal basis for processing your personal data will be outlined in 4FILL's Privacy Policy. Use of your 4FILL account and your personal data will be subject to 4FILL's Privacy Policy, which is available at [Insert Correct 4FILL.com Privacy Policy URL].

16.2 Your personal data is held securely and may be transferred to secure servers outside the UK and EEA, in accordance with applicable data protection laws. Further details on how we protect your information, including information on international data transfers and safeguards, are available in our Privacy Policy.

16.3 In instances where the Hirer's personal data related to this service is shared with the Manufacturer (Panasonic UK) by 4FILL, this disclosure is limited to service administration and the Manufacturer's internal record-keeping requirements. The Hirer is encouraged to consult the Manufacturer's privacy policies for further information regarding the processing of personal data by Panasonic UK. [Insert Correct Mftr Privacy Policy URL].

16.4 Personal data will be retained by 4FILL in accordance with our Privacy Policy and applicable data protection laws.

 

  1. GENERAL INFORMATION

17.1 These Terms and Conditions constitute the entire agreement between you and us and supersede all prior agreements between us.

17.2 Any failure by us to exercise or enforce any right or provision of these Terms and Conditions shall not constitute a waiver of such right or provision.

17.3 If any provision of these Terms and Conditions is found by a court of competent jurisdiction to be invalid, the parties nevertheless agree that the court should endeavour to give effect to the parties' intentions as reflected in the provision, and the other provisions of these Terms and Conditions shall remain in full force and effect.

17.4 Neither you nor we may assign or transfer any rights or obligations under these Terms and Conditions without the prior written consent of the other party, except that we shall be entitled to assign or transfer any or all of our rights and obligations (without your prior consent) to any of our fellow group companies.

17.5 Any telephone calls between The Company and the Hirer may be recorded, in which case the recordings will be accepted by the Hirer as evidence of the instructions or communications recorded. The Hirer, by accepting these terms and conditions, acknowledges, and accepts that evidence of any such recordings may be referred to by The Company in respect of any dispute or difference between the parties.

17.6 The section titles in these Terms and Conditions are for convenience only and have no legal or contractual effect.

17.7 By registering with 4FILL, accessing The Website, booking Equipment, and participating in this Promotion, all Hirers are deemed to have read and agreed to be bound by these Terms and Conditions, 4FILL’s Terms of Use (found at https://www.lumixloan.com/terms-of-use/), and the Manufacturer's own policies. In the event of any conflict between these Terms and Conditions for the Promotional Equipment Hire and the 4FILL's Terms of Use, these Terms and Conditions shall prevail in relation to the hire of Equipment under this promotion.

17.8 These Terms and Conditions and any dispute or claim arising out of or in connection with them or their subject matter or formation (including non-contractual disputes or claims) shall be governed by and construed in accordance with the laws of England and Wales. The English courts will have exclusive jurisdiction over any claim arising from, or related to, our site and the services provided although we retain the right to bring proceedings against you for breach of these Terms and Conditions in your country of residence or any other relevant country.  

 

  1. VARIATIONS

18.1 We may revise these Terms and Conditions at any time by amending this page. You are expected to check this page from time to time to take notice of any changes we made, as they are binding on you. Some of the provisions contained in these Terms and Conditions may also be superseded by provisions or notices published elsewhere on our site.

 

  1. CONFIRMATION

19.1 The Hirer confirms that all details given in their application to hire the Company’s Equipment are true and complete. They also confirm they have read and retained a set of the Terms and Conditions governing the Agreement.
